PetStyle Rules

NO PURCHASE NECESSARY TO ENTER OR TO WIN. The SPCA PetStyle Contest, brought to you by Dog.com (the "Contest") begins at 12:00:00pm (noon) Pacific Time ("PT") on Friday, May 11, 2007 and ends at 12:00:01am (midnight) Pacific Time ("PT") on Friday, July 6, 2007. SPCA International ("The SPCA") is the primary sponsor of the Contest and reserves the right to modify the start and end dates at its sole discretion. Please contact the SPCA at 2121 K Street, N.W. ELIGIBILITY: The Contest is open only to legal residents of the 50 United States and the District of Columbia who are currently residing therein, excluding Puerto Rico and all other territories, who are 18 years of age or older at the time of Contest registration. Military personnel and their dependents who are legal residents of the United States are eligible to participate regardless of their assignment. Failure to comply by providing incorrect information will invalidate your Contest entry, which will result in the loss of potential prize winning. Employees, officers and directors of the SPCA and the Contest's sponsors, their respective parents, affiliates, subsidiaries, advertising, promotional, fulfillment and marketing agencies, their immediate families (parent, child, sibling and spouse) and persons living in the same households as such individuals, whether related or not, are not eligible to participate in the Contest. By entering the Contest, participants agree to release, indemnify, discharge and hold harmless the SPCA and the Contest's sponsors, their respective parents, affiliates, subsidiaries, retailers, agencies and their respective officers, directors, employees and agents, from any and all damages, whether direct or indirect, which may be due to or arise out of participation in the Contest or any portion thereof, or the acceptance, use/misuse or possession of prizes. By participating, you agree to these Official Rules and to the decisions of the autonomous judges which are final and binding in all respects. Void where prohibited by law, rule or regulation. You further agree to the fair use of any material you submit, as well as to the fair use by the SPCA of your and/or your pet's name and likeness should you be a winner. All federal, state and local laws and regulations apply. Further, please be aware that any content deemed inappropriate (e.g., pornography, sexual or racial slurs, inappropriate language, obscenities, photos that place the pet in jeopardy or danger, any photos found inappropriate for the contest, or otherwise deemed inappropriate) by the SPCA will be immediately disqualified and not eligible for consideration. Any submission that has been previously published or has won awards in similar contests will be immediately disqualified and not eligible for consideration, as will any submission that in any way infringes upon the intellectual property of a third party.

HOW TO PLAY: No purchase necessary to play. There is no limit to how many times you may enter. To enter the Contest, go to the URL listed on the informational package you received or go to the following Web site address: www.spca.com/contest. When submitting a photo, you must enter your true and correct information in all required fields and then hit the "Submit" button to initiate one (1) Contest entry. All files submitted are subject to review before they are accepted.

To be eligible for consideration for a prize, each entrant must submit a minimum of one (1) picture of the entrant's own pet -- cat or dog only -- and should be prepared to demonstrate ownership of that pet if requested. Contestants must provide photos in JPG file format only. No other formats and no prints of photos will be accepted. Each entrant must also provide a valid e-mail address, first and last name, street address and phone number. Entries will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at time of entry. In the event of a dispute regarding the identity of any potential winner, the potential winner will be deemed to be the authorized account holder of the e-mail address submitted at time of entry. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Any potential winner must provide the SPCA with satisfactory proof that he/she is the authorized account holder of the e-mail address associated with the potentially winning Contest entry.

Entries generated by a script, macro or other automated means will be disqualified. Entries that are incomplete, illegible or corrupted are void and will not be accepted. By entering the Contest, each entrant recognizes and agrees to all of the terms and conditions of the Contest's Privacy Policy.

Please be aware that by submitting an entry, you are granting the SPCA the right to use and publish your name and biographical information. By entering the Contest, each entrant recognizes and agrees that each submitted photo becomes the property of the SPCA and/or its designees for promotional use, public relations, marketing or other purposes.

JUDGING: You may submit any number of photos, though photos must be submitted one at a time. Submitted photos are first reviewed by the SPCA to determine whether such photos are appropriate for the contest and the determination of appropriateness shall be made at the SPCA's sole and exclusive discretion. If approved, the contestant receives notification by e-mail, the photo appears on the Contest Web site and the public can start voting on it. If the photo is rejected, you will be notified by e-mail and the photo will not appear on the Contest Web site. Voting will be based on public perception regarding the entertainment value of the submitted photo, and subjective criteria such as the appearance of your pet in the photo will likely apply. All judging shall be based on subjective standards of those who visit the site and vote. Contest winners are determined by the total number of votes received and the average "star" rating of the votes. Photos will be voted upon and then subjectively rated by each voter via "star" ratings. Photos are then ranked based on the total number of votes and stars received. The top ten (10) ranked photos will be the winning photos. Voting may continue for the entire period of the contest (8 weeks). Once the public voting ends, the ten (10) Photos (the SPCA reserves the right to expand that number if voting is significantly higher than expected) with the most votes (calculated by the method described below) are considered Finalists. A panel of judges selected by the SPCA (which may include SPCA members and organizers) will choose the winners and award the final prizes. Voters will be required to provide an e-mail address and password before they will be eligible to vote. Voters may vote on any number of photos at any time, although they may vote only once per photo. Voting is on a scale of 1-4 "stars," with 4 stars being the highest. Photos with the highest average score are considered the most popular and once the voting ceases, as determined by the SPCA, the top 10 photos will be considered finalists. Any photo considered for the finalist category must receive a minimum of 50 votes.

CONTEST PRIZES: The Contest winners and each recipient of a prize shall be chosen by a popular vote as herein described. Prizes shall include:

GRAND PRIZE (one winner): A trip for two (2) people to Beverly Hills, California, including roundtrip first class airfare, courtesy of Delta Air Lines, from any Delta Air Lines gateway city in the United States to Los Angeles; three (3) nights at the Peninsula Hotel, Beverly Hills; limo service between Los Angeles International airport and the Peninsula Hotel; two (2) days car rental (optional); a gift certificate for $150 and reservations for dinner for two at Spago in Beverly Hills; a gift certificate for $100 and reservations for dinner for two at Typhoon in Santa Monica; a small Komfort Pets Carrier; a $100 gift certificate to Dog.com; one year supply of Dogswell or Catswell treats; one year Pets First plan with Pets Wellness plan from Pets Best pet insurance; a sheet of 20 U.S. Postal Service stamps with winning photo of pet; an SPCA T-shirt

FIRST PRIZE (two winners): A small Komfort Pets Carrier; one large Dogswell or Catswell/Dogswell Sample Pack; a $50 gift certificate to Dog.com; one year Pets First plan from Pets Best pet insurance; a sheet of 20 U.S. Postal Service stamps with winning photo of pet; an SPCA T-shirt

SECOND PRIZE (three winners): A small Komfort Pets Carrier; one medium Dogswell or Catswell/Dogswell Sample Pack; a $25 gift certificate to Dog.com; one year Pets Basic plan from Pets Best pet insurance; a sheet of 20 U.S. Postal Service stamps with winning photo of pet; an SPCA T-shirt

THIRD PRIZE (four winners): A small Komfort Pets Carrier; one small Dogswell or Catswell/Dogswell Sample Pack; one year Pets Accident plan from Pets Best pet insurance; a sheet of 20 U.S. Postal Service stamps with winning photo of pet; an SPCA T-shirt

PRIZES FOR ALL APPROVED CONTESTANTS: Every contestant who submits one photo approved for contest usage will receive, via e-mail, both a $10 gift certificate to Dog.com (limit one per contestant), which shall be mailed to all eligible contestants at the end of the contest, and a free one-year gift membership (for one pet only) with The Pet Protector System by 1-800-HELP-4-PETS (limit one per contestant)

The actual value may vary based on several factors, including date of use. Certain restrictions may apply. Each winner must claim his/her prize within one year following notification of winning, or prize may be forfeited and awarded to an alternate winner. All other expenses and costs not expressly listed above are each winner's sole responsibility. Released parties are not responsible for lost or mutilated personal belongings and none will be replaced.

PRIZE AWARDING: Prizes will only be awarded upon potential winners' verification and final approval by the SPCA. No prize substitution, cash equivalent of prizes, transfer or assignment of prize is permitted, except by the SPCA at its sole discretion, due to prize unavailability for any reason, and only then for a prize of equal or lesser value. If a winner of any prize is a minor, prize will be awarded to the parent or legal guardian. Potential winning entrants will receive prize notification via e-mail, United States Postal Mail and/or overnight mail. If the potential winning entrant of any prize cannot be contacted, is ineligible or fails to claim the prize, if the prize notification is returned undeliverable, or if the potential winner otherwise fails to fully comply with these official rules, he/she will forfeit that prize and the prize will be awarded to an alternate potential winner. Each potential winner will receive notification that he/she has won and will have (30) days from receipt of winning notification to confirm that the notification has been received. After confirming notification receipt, the potential winner will be sent via United States Postal Mail and/or overnight mail (i) an Affidavit of Eligibility/Compliance & Publicity/Liability Release Form as well as (ii) a Pet Statement Form on which the potential winner shall provide information about himself/herself and his/her pet(s). Statement may be edited for content, clarity and grammar before being displayed or otherwise made public and may be made public at the SPCA's discretion. The Affidavit and Pet and Pet Statement Forms must be completed, signed, notarized and returned to the SPCA within (15) days. Each potential winner then, and only then, becomes a "Winner." If the potential winning entrant of any prize cannot be contacted, is ineligible, fails to return the completed and executed Affidavit and Release or Pet Statement or fails to claim the prize, if the Prize Notification is returned undeliverable, or if the potential winner otherwise fails to fully comply with these official rules, he/she will forfeit that prize and the prize will be awarded to an alternate potential winner. Each Winner grants the SPCA the right to use and publish his/her full name and city and state of residence online, in connection with the Contest. Acceptance of a prize constitutes permission for the SPCA and its affiliates to use Winner's name and likeness solely for advertising and promotional purposes for this Contest without notice or further compensation, except where prohibited by law. All information collected will be treated in a manner consistent with the SPCA's privacy policy. In the event of a dispute, an entry will be deemed to have been made by the authorized holder of the e-mail account at the time the entry was made. All decisions of the judges shall be binding and final.

DISQUALIFICATION: Neither the SPCA nor its affiliates are responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, incorrect or inaccurate entry information, howsoever caused, or other error of any kind whether human, mechanical or electronic. Entrants found tampering with or abusing any aspect of this Contest, as solely determined by the judges, will be disqualified. If disqualified for any of the above abuses, the SPCA reserves the right to terminate entrant's eligibility to participate in the Contest. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be in violation of criminal and civil law, and, should such an attempt be made, the SPCA reserves the right to seek damages from any such person to the fullest extent permitted by law. The SPCA's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The SPCA reserves the right to terminate, cancel, suspend and/or modify the Contest if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Contest, as determined by the SPCA at its sole discretion. In such event, the SPCA reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. The SPCA reserves the right to award only the number of prizes stated in the Official Rules. In no event will more prizes be awarded than those listed herein.

TAX INFORMATION: All federal, state, local and other taxes on prizes are the sole responsibility of the applicable winner.

GENERAL INFORMATION: This Contest is conducted in English (which will be given its everyday ordinary meaning), and any and all disputes will be resolved in accordance with the laws of the State of California without regard for conflict-of-laws provisions.
